Case Study: Easement Dispute

The owner of a three family house believed that he owned the entire driveway between his property and that of his adjoining neighbor, who had used the driveway consistently for 25 years to reach her garage. When a dispute arose between one of his tenants and the neighbor, the owner of the multifamily installed a fence to keep the neighbor from using the driveway. The neighbor brought an action in the Land Court. To preserve good relations and save money, they decided to mediate.


Result
They settled their dispute by structuring a plan together for reciprocal driveway use, allowing them to sustain a harmonious relationship.
