Mediation is an informal, confidential ADR process in which in which a trained impartial professional--often a lawyer or former judge--acts as a facilitator, guiding disputing parties to a mutually agreeable solution. Without determining right or wrong, or making or forcing a decision, the mediator helps each side identify real interests and explore creative options for mutual gain--often without compromise. The flexibility and creativity of the process permits settlements tailored to the individual parties' needs. Control remains in the hands of those involved in the conflict.
